EventSpark Platform Agreement
Welcome to EventSpark, operated by EventSpark. These Terms and Conditions (“Terms”) govern your access to and use of the EventSpark platform, including all associated websites, applications, services, quest systems, loyalty point programs, and leaderboard features (collectively, the “Service”).
By creating an account or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

01Eligibility & Account Registration
You must be at least 13 years of age to create an account. If you are between 13 and 18, you represent that a parent or legal guardian has reviewed and consents to these Terms on your behalf.
When registering, you agree to:
- Provide accurate and complete information, including a valid email address and chosen username.
- Maintain the security of your password and account credentials.
- Accept responsibility for all activity that occurs under your account.
- Not create multiple accounts for the purpose of abusing promotions, point accrual, or leaderboard rankings.
- Notify EventSpark immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for fraudulent activity, at our sole discretion and without prior notice.
02EventSpark Points: Non-Cash Value & Restrictions
EventSpark Points are a virtual, non-monetary unit of recognition within the EventSpark ecosystem. They are not currency, have no cash value, and cannot be exchanged for legal tender.
Specifically, EventSpark Points:
- Cannot be purchased, sold, bartered, or exchanged for real-world currency or cryptocurrency.
- Cannot be transferred between accounts unless explicitly enabled by an event administrator.
- May only be redeemed for rewards, perks, or items made available within the platform's reward shop.
- Have no value outside the Service and confer no property rights.
- May be adjusted, reset, or forfeited by EventSpark in cases of abuse, system error, or policy violation.
- Are subject to expiration policies as defined per event or store configuration.
Rewards redeemed through the points shop are subject to availability and may be modified or discontinued at any time. EventSpark makes no guarantee as to the continued availability of any specific reward. All redemptions are final unless otherwise stated.
03Quests, Submissions & Fair Play
The Service may offer quests, challenges, and tasks that allow users to earn EventSpark Points upon completion. Quest submissions may require photo evidence, text responses, or other proof of completion and are subject to review by event administrators.
You agree that:
- All submissions must be genuine, original, and accurately represent the completed task.
- Fabricated, manipulated, or misleading submissions are grounds for immediate point forfeiture and account suspension.
- Administrator decisions regarding submission approval or rejection are final.
- Quest availability, point values, and requirements may change without notice.
- Automated submissions, bots, scripts, or any form of system manipulation is strictly prohibited.
04Leaderboards & Rankings
Leaderboards display user rankings based on accumulated EventSpark Points. Your display name and point totals may be visible to other participants within the same event or store.
- Leaderboard positions confer no contractual entitlement to prizes or rewards unless explicitly stated in a specific promotion's official rules.
- EventSpark reserves the right to remove users from leaderboards for policy violations.
- Rankings may be recalculated if point adjustments are made due to errors or abuse.
- Tie-breaking rules are at the discretion of the event or store administrator.
05Data Privacy & Information Collection
By using the Service, you consent to the collection, processing, and storage of certain personal information necessary to provide the Service. This includes:
- Account information: email address, username, display name, and optional profile details such as phone number.
- Usage data: quest completions, point balances, redemptions, leaderboard activity, and login timestamps.
- Technical data: IP addresses, browser type, device identifiers, and session information for security and analytics purposes.
We commit to the following data handling principles:
- Your personal information will not be sold to third parties.
- Data is encrypted in transit (TLS) and at rest where applicable.
- You may request export or deletion of your personal data by contacting us at the email below.
- We retain data only for as long as necessary to provide the Service or as required by law.
- We employ industry-standard security measures including row-level security, rate limiting, and encrypted credential storage.
06Communications & Newsletter Consent
By creating an account, you agree to receive the following communications:
- Transactional emails: account verification, password resets, quest approval notifications, and reward redemption confirmations. These are essential to the Service and cannot be opted out of while maintaining an active account.
- Promotional emails: newsletters, platform updates, new feature announcements, event invitations, and partner offers from EventSpark. You may opt out of promotional communications at any time using the unsubscribe link included in every email.
Opting out of promotional emails does not affect transactional communications. We respect your inbox and will not send excessive communications.
07Acceptable Use Policy
You agree not to:
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or connected systems.
- Use the Service for any illegal, harmful, or fraudulent purpose.
- Interfere with or disrupt the Service's infrastructure, including through denial-of-service attacks or excessive automated requests.
- Reverse-engineer, decompile, or attempt to extract source code from the Service.
- Impersonate another user, administrator, or representative of EventSpark.
- Upload malicious content, including but not limited to viruses, malware, or scripts designed to exploit the Service.
- Exploit bugs, glitches, or unintended functionality. Responsible disclosure to george@mail.eventspark.gg is appreciated.
- Engage in harassment, hate speech, or abusive behavior toward other users or administrators.
08Intellectual Property
All content, design, logos, trademarks, software, and technology comprising the Service are the property of EventSpark or its licensors and are protected by applicable intellectual property laws.
- You retain ownership of content you submit (e.g., quest photo submissions), but grant EventSpark a non-exclusive, worldwide, royalty-free license to use, display, and store such content in connection with the Service.
- You may not copy, reproduce, distribute, or create derivative works from any part of the Service without prior written consent.
- User-generated content that violates third-party intellectual property rights may be removed without notice.
09Service Reliability, Recovery & Limitation of Liability
We take the reliability and security of the Service seriously. Our infrastructure is built on enterprise-grade hosting with automated backups, encrypted data storage, and continuous monitoring. We strive for maximum uptime and invest in redundancy to minimize disruptions.
Our commitment to you:
- We maintain automated, regular backups of all user data, including point balances, quest completions, and account information.
- In the event of unintended data loss or a system incident, we will make commercially reasonable efforts to restore affected data from the most recent available backup and will communicate transparently about the scope and timeline of recovery.
- We employ industry-standard security practices including encryption in transit and at rest, row-level access controls, rate limiting, and routine security reviews.
- Planned maintenance windows will be communicated in advance whenever possible.
While we work diligently to prevent issues, no software system can guarantee 100% uninterrupted or error-free operation. In the unlikely event of an extended outage or data incident beyond our reasonable control (including force majeure events such as natural disasters, infrastructure provider failures, or cyberattacks), the following applies:
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- EventSpark will prioritize restoring service and recovering data promptly, but cannot guarantee that every data point will be recoverable in all circumstances.
- In no event shall EventSpark's total liability exceed the greater of $50 USD or the amount you have paid to EventSpark in the 12 months preceding the claim.
- We are not responsible for the actions, products, or services of third-party providers, including payment processors and POS systems, though we carefully vet all integrations we rely on.
10Modifications to Terms
EventSpark reserves the right to update or modify these Terms at any time. Material changes will be communicated via email to the address associated with your account or through a prominent notice within the Service. Your continued use of the Service following such notice constitutes acceptance of the revised Terms.
11Termination
Either party may terminate this agreement at any time. You may delete your account through your dashboard settings or by contacting us. EventSpark may suspend or terminate your account for violations of these Terms.
Upon termination, all accumulated EventSpark Points are forfeited and cannot be recovered. Sections regarding Disclaimers, Limitation of Liability, and Intellectual Property survive termination.
12Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Pennsylvania, United States, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, with proceedings conducted in Pennsylvania. You waive any right to participate in a class action lawsuit or class-wide arbitration.
